Lawsuit Challenges Wyoming’s First-in-Nation Ban on Abortion Pill

The most utilized abortion procedure in America is now the abortion pill, according to the Guttmacher Institute, a pro-choice research organization spun off from Planned Parenthood. More than half of all abortions in America are carried out using the abortion pill, but Wyoming just became the first state to ban the pill entirely. 

Wyoming Gov. Mark Gordon, a Republican, signed a bill Friday that makes it a felony to sell, use, or prescribe “any drug for the purpose of procuring or performing an abortion.” 

Breaking the law could result in a six-month jail sentence and a $9,000 fine. The law is supposed to take effect July 1, but is facing a legal challenge. 

On Tuesday, a pro-abortion group filed an amended lawsuit aimed at preventing the ban on abortion pills from taking effect in Wyoming. Wellspring Health Access is an abortion facility hoping to open soon as the second abortion clinic in the state. 

“Wyomingites deserve access to the full spectrum of reproductive health care,” Julie Burkhart, president of Wellspring Health Access, said in a statement, adding, “That’s why we are fighting to keep medication abortion legal in Wyoming.” 

The process of a chemical abortion begins when a woman takes mifepristone, which prevents the baby in the womb from receiving the hormone progesterone. Without progesterone, the lining of the uterus deteriorates, ultimately resulting in the unborn child’s death.  

Usually, one or two days after taking mifepristone, women take a second pill, misoprostol, to complete the abortion. Misoprostol causes a woman to have contractions that eventually expel the dead baby from her uterus.

Abortion advocates are also challenging an abortion ban that went into effect in Wyoming on Sunday. The pro-life bill makes abortions illegal in almost all cases because, as the bill states, an “unborn baby is a member of the human race.”

Wyoming’s ban on the abortion pill comes as a U.S. District Court in Texas is considering a preliminary injunction in a case that could ban the abortion pill nationwide. 

In November, a group of medical doctors and organizations filed a lawsuit against the U.S. Food and Drug Administration over its approval of chemical abortion drugs. 

The Christian legal organization Alliance Defending Freedom represents four physicians and four pro-life groups, including the American Association of Pro-Life Obstetricians and Gynecologists, who argue that the FDA approved the drugs before they ever properly studied mifepristone for safety.
