Mexico’s immigration chief is expected to face charges in connection with a deadly fire that killed 40 migrants near the U.S. border, the Associated Press reported Wednesday.

The fire broke out in a migrant detention center in Juarez, Mexico, in March near El Paso, Texas. Chief of Mexico’s National Immigration Institute Francisco Garduño will face charges for allegedly not doing anything to prevent the situation even though he knew of issues with the agency’s detention centers, according to the AP.

The Mexican attorney general’s office will also charge several officers of Garduño’s agency as prosecutors said the case shows a “pattern of irresponsibility,” according to the AP.

“The door was closed, because the person who had the keys wasn’t there,” Mexican President Andres Manuel López Obrador said after scrutiny was placed on two guards that appeared in a video walking away during the fire, according to the AP.

Three Mexican immigration officials, a guard and a Venezuelan migrant are all currently detained over the investigation into the fire, facing homicide charges, according to the AP.

Mexico has returned 31 bodies of the victims to their home countries, which include Guatemala, Honduras and El Salvador, according to the AP.
