Mail-in votes could have a significant impact on another election.

The Virginia Institute for Public Policy filed a lawsuit alleging that election officials in Fairfax County improperly accepted absentee ballot applications, which was dismissed by Virginia Judge Michael Devine.

The decision was made just days before the much-anticipated gubernatorial election on Tuesday.

The claim was rejected by Devine on technical grounds, not on the merits, since the plaintiffs lacked standing.

Fairfax County, according to the Virginia Institute for Public Policy, did not require mail-in ballots.
